Peggy Labat - English'n Stuff is a training organization. We provide English language training and consulting services for immersion in English-speaking countries. Your privacy is important to us, and protecting your personal data is a priority.

In the context of the training courses we offer or the provision of advice for an immersion stay, we may collect personal data about you.

The purpose of this policy is to inform you about how we process this data in compliance with the French Data Protection Act (loi "Informatique et Libertés" n°78-17 du 6 janvier 1978 modifiée), as well as with Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter the "RGPD").

What data do we collect?

Personal data is data that can be used to identify an individual, either directly or by cross-referencing with other data. 

We collect data in the following categories:

  • Identification data (in particular your surname, first names, e-mail and postal addresses, telephone number);
  • Connection data (including your IP address and connection log);
  • Data relating to your professional life (in particular your qualifications and profession);
  • Data from emails you have exchanged with us (e.g. email content, dates);

The information we hold on participants in our training courses and in preparation for a stay abroad enables us to carry out our projects successfully.

Our customers are mostly adults and parents who want to send their children to a camp, language school or boarding school in an English-speaking country. These children also need to know their rights and this policy also applies to them. All are protected by the RGPD. If you are a minor, some parts of this policy are particularly applicable to you.

We collect your personal data through mailing lists, newsletters, emails, telephone calls and appointments.

We only process this information with your permission.

School reports and sensitive data - When you ask us to send your child to a boarding school, we will ask you for his or her school reports so that we can pass them on to the relevant schools to assess your child's level. This includes date of birth, past schools, academic references, grades and teachers' opinions. A photo of the child may also be required. We will only accept this data when it is provided by you and with your permission. The information we collect includes your responses to surveys, which may include your personal opinion, as well as personal data such as your name, address, zip code, IP address, gender, age, date of birth and e-mail address,

Some of the data collected and processed by Peggy Labat concerns minors; it is therefore particularly important to understand the rules governing the consent of minors. In France, sharing the personal data of children under the age of 15 requires parental consent. Although any request for placement in a school or camp will only be made after a private and personal discussion, we will always ask for your explicit consent to process this data. If the child is over 15, we will always discuss the placement with the parents as required by the service. We will make sure to inform the child of his or her rights where possible and legally required.

Although the European Union specifies that the age of consent is 16, this varies from member state to member state. If you live in another member state, please contact us for more information.

Why and how do we manage your personal data?

This paragraph explains why we accept and process your personal data, as well as the reasons why we do so, including our legal justification and legitimate interests. We will never use your data for any purpose other than the one for which you gave it to us.

Newsletter data - Newsletter data will be used to enable us to send you a newsletter. We may also ask you to update our databases to ensure that your information is correct, and to provide feedback on the service. Our legal justification for doing so is your consent. We have created this newsletter for adults, however, if you are a minor and would like to subscribe, please ask your parents for help.

Emails, calls, and conversations - We hold these appointments with the customer prior to any training or boarding school placement. All data collected during these appointments will only be used to find the best option for your child. Our legal justification for this is your consent and the fulfilment of our contractual duties. Where possible and necessary, we meet with the child's parents to inform them of their rights.

Report cards and sensitive data (special category) - We use your child's report cards and other sensitive data to find the best possible school and camp for your child. These are collected and transferred to potential schools and camps (only when strictly necessary) (see paragraph 5, Disclosure). This is done so that the school and you can decide whether your child will fit in well at this school. Our legal justification for doing so is your consent and the fact that it is necessary to perform our contractual duties. To process your special category personal data, under Article 9(2)(a), we will ask for your explicit consent. This data will only be used for purposes that are specific to each child. All will be discussed with you individually and will be transferred to the schools and camps you have chosen.

If you are a child, please be aware that we only process your personal data to find the best school or camp for you. We only transfer this data to the three schools (sometimes more) that you and your parents have chosen. Because we provide a purely personal service, we need to know a little more about you, otherwise you may find yourself in a camp that's not at all suitable for you. In the highly unlikely event of a complication or accident at camp or school where your child is placed, we may collect certain information to assist you. This information will also be subject to RGPD rules.

Cookies

Cookies are text files, often encrypted, stored in your browser. They are created when a user's browser loads a given website: the site sends information to the browser, which then creates a text file. Each time the user returns to the same site, the browser retrieves this file and sends it to the website's server.

We can distinguish between two types of cookies, which have different purposes: technical cookies and advertising cookies:

  • Technical cookies are used throughout your browsing experience, to facilitate navigation and execute certain functions. A technical cookie may, for example, be used to memorize the answers entered in a form, or the user's preferences regarding the language or layout of a website, where such options are available.
  • Advertising cookies may be created not only by the website on which the user is browsing, but also by other websites displaying ads, widgets or other elements on the page displayed. In particular, these cookies can be used to carry out targeted advertising, i.e. advertising determined according to the user's browsing habits.

We use technical cookies. These are stored in your browser for a period not exceeding six months.

We do not use advertising cookies. However, if we were to use them in the future, we would inform you in advance and you would have the option of deactivating these cookies.

We use or may use Google Analytics, a statistical audience analysis tool that generates a cookie to measure the number of visits to the site, the number of pages viewed and visitor activity. Your IP address is also collected to determine the city from which you are connecting. The length of time this cookie is kept is mentioned in article 7 (v) of the present charter.

We remind you that you can refuse to accept cookies by configuring your browser. However, such refusal may prevent the site from functioning properly.

Consent

When you choose to communicate your personal data, you expressly give your consent to the collection and use of such data in accordance with the provisions of this charter and current legislation.

Embedded content from other sites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other sites behaves in the same way as if the visitor were visiting that other site.

These websites may collect data about you, use cookies, embed third-party tracking tools, track your interactions with these embedded contents if you have a logged-in account on their website.

Use and transmission of your personal data

Peggy Labat, the services responsible for control (auditor in particular), public bodies, exclusively to meet our legal obligations and our partners will have access to your personal data (hosting provider, training management software, sending newsletters, CRM tool).Newsletter- We use Mailchimp software to save your emails to send you newsletters accurately and quickly. We chose this software because it is one of the leaders in its field. Like other third parties to whom we transfer data, we require them to comply with the law when processing your data.

 Schools and camps - We transfer your personal data to the schools and camps that interest you so that they can determine whether they are suitable for you. These decisions are made taking into account your child's academic level and interests. To do this, we'll give you several school or camp options. Once you have chosen your preferred option, we will share your child's data with the school with your explicit consent. This data includes report cards and other information (see paragraph 4).

We do our best to check that our partner schools comply with RGPD rules. Once the data is transferred, we will tell you, if you ask us, where to find their privacy policy.

Before sending your personal data to a school or camp, we will always speak with your parents and ask for their explicit consent. We will also ask you if this is legally required, as you have the right to know what is being done with your personal information. We will never transfer your personal information to anyone who does not have the right to receive it, and you can ask us at any time who has access to your data. Transfer of data outside the European Union - In some cases, you may choose to send your child to a school outside the European Union, for example to the United States or New Zealand. These schools and camps are located outside the European Economic Area. When you make this request, we will only transfer data with your explicit consent. Although these countries are not governed by the same rules as the European Union, they maintain strict standards of confidentiality. If you suggest a country that does not have good privacy standards, we will firmly discourage you from sharing your sensitive data with them.

Data storage periods

Concerning data relating to the management of customers and prospects: your personal data will not be kept beyond the period strictly necessary for the management of our commercial relationship with you. However, data required to establish proof of a right or contract, or to comply with a legal obligation, will be kept for the period stipulated by the law in force.

With regard to any prospecting operations aimed at customers, their data may be kept for a period of three years from the end of the commercial relationship. Personal data relating to non-customer prospects may be kept for a period of three years from the date of collection or last contact with the prospect. At the end of this three-year period, we may contact you again to find out whether you wish to continue receiving commercial solicitations.

 

Concerning identity documents: in the event of exercising the right of access or rectification, data relating to identity documents may be kept for the period stipulated in article 9 of the Code of Criminal Procedure, i.e. one year. If the right to object is exercised, such data may be archived for the period of limitation stipulated in article 8 of the Code of Criminal Procedure, i.e. three years.

Concerning the management of lists of objections to receiving canvassing: the information enabling us to take account of your right to object is kept for a minimum of three years from the date on which you exercise your right to object.

Concerning audience measurement statistics: information stored in users' terminals or any other element used to identify users and enabling their traceability or frequentation will not be kept beyond 6 months.

The rights you have over your data

Your rights in relation to your personal data are set out below. To exercise these rights, please submit your request to our Data Protection Officer (see "Contact us" below) and we will comply with any request to the extent permitted by applicable law.

  • Right of access - you can ask to see the personal information we hold about you (and certain other information) and we will disclose it to you free of charge (restrictions apply). We will ask you to prove who you claim to be.
  • The right of rectification - if the information we hold about you is incomplete or inaccurate, you have the right to have it corrected. If we have shared your information with others, we will inform them of the rectification where possible. If you ask us to, we will also tell you with whom we have shared your information.
  • The right to erasure - you can ask us to delete or erase your information in certain circumstances, for example when we no longer need it or if you withdraw your consent (if applicable). If we have shared your information with others, we will inform them of the deletion where possible.
  • The right to restrict processing - you can ask us to "block" or prevent the processing of your information in certain circumstances, for example when you dispute the accuracy of the information or object to its processing. This will not prevent us from storing your information, but we will notify you before any restrictions are lifted. If we have shared your information with others, we will inform them of any restrictions where possible.
  • The right to data portabilitý - you have the right, in certain circumstances, to obtain information you have provided to us (in a structured, commonly used and computerized format) and to reuse it elsewhere.
  • The right to object - you can ask us to stop processing your information if we :
    • process your information in our own interest or in the interest of someone else;
    • process your information for direct marketing purposes; or
    • process your information for research purposes.
